1) ESTATEB2B TERMS OF SERVICE
1. Parties and Definitions
This agreement governs the terms of use of services offered through the website/mobile application between EstateB2B (the “Platform”) and the Member (guest or property owner) using the Platform.
Definitions:
Property Owner: a member who creates a listing and offers accommodation.
Guest: a member who requests a booking for, or stays at, a listing.
Listing: a page created by the property owner containing price, location, rules and features.
Booking: an accommodation request made by a guest based on a date range and number of persons.
Daily Apartment: listings of the gunluk-daire type (booking rules are specific to this type).
2. Role of the Platform
EstateB2B is an intermediary between the parties. Accommodation is provided by the Property Owner, not EstateB2B. EstateB2B may provide listing publication, booking/payment infrastructure, messaging, complaint management and security processes; however, it is not itself a party to the accommodation.
3. Membership and Account Security
Accurate and current information is required for membership. Account password and access security are the member’s responsibility. A false identity or membership in another person’s name is grounds for account closure. EstateB2B may request identity verification (KYC) where necessary.
4. Proper Use and Prohibitions
The following are strictly prohibited: false listings / misleading photographs / incorrect addresses; listing on behalf of another person; directing users to off-platform payment/communication (“let’s handle it on WhatsApp”, etc.); review manipulation or false reviews; insults, threats or spam; attempts to exploit security vulnerabilities or collect data (scraping); copyright infringement in content. In case of a violation, EstateB2B may remove the listing, cancel the booking, block payment or close the account.
5. Content Licence (Photos/Texts)
The member acknowledges that they hold the right to use the content they upload. The member grants EstateB2B a limited, non-transferable right to publish their content on the Platform.
6. Booking Flow and Confirmation
A booking is created according to the rules on the listing page. The confirmation process may be “automatic confirmation” or “property-owner confirmation”. The guest acknowledges that dates, number of persons, pet information and similar details are accurate.
7. Messaging and Records
On-platform messages may be recorded for security, fraud prevention and dispute resolution.
8. Limits of Liability
EstateB2B is not directly responsible for matters such as the condition of the home, neighbour noise, infrastructure interruptions or the property owner’s fault. Except in cases of intent/gross negligence, EstateB2B’ liability may be limited to the service fee paid.
9. Right to Amend
EstateB2B may update this agreement. The current text takes effect when published. Notice may be given for material changes.
10. Governing Law and Jurisdiction
The law of Turkey/Istanbul applies to this agreement. Competent court: Istanbul.
2) PROPERTY OWNER TERMS
1. Listing Accuracy
The property owner must accurately enter the address/location, photographs, price, features, capacity and rules. Misleading information may result in refund + listing removal + account sanction.
2. Property Owner Obligations
The property owner must deliver the home ready on the stated dates; properly carry out cleaning/key handover; keep the “house rules” in the listing clear and enforceable; and assume responsibility for local legislation (licences, tax, building rules).
3. Special Daily Apartment Rules
For gunluk-daire listings, min_days, max_days and gap_days (gap between bookings) apply as determined by the property owner. Maximum person limits are max_adults / max_children / max_infants. Rule violations (excess persons, party, neighbour complaint) may result in immediate termination of the booking.
4. Cancellation and Property Owner Penalty Logic
If the property owner cancels shortly before guest check-in, the guest suffers a detriment. EstateB2B may apply a penalty charge, lower the listing in search results or suspend the listing.
5. Damage / Deposit / Loss Claims
To claim damage, the property owner must submit evidence such as check-in/check-out photos and an invoice/service record. The deadline for a damage claim is, for example, within 48 hours after check-out. Normal wear and tear is not “damage”.
6. Tax and Official Notifications
Tax/fees/licences/accommodation notifications and similar obligations belong to the property owner.
3) GUEST TERMS
1. Accurate Information and Identity
The guest must correctly enter the number of persons, check-in/check-out dates and pet information. EstateB2B may request identity verification where necessary.
2. Compliance with House Rules
The guest agrees to comply with the rules on the listing page: smoking / party / noise / visitor / pet rules, apartment/site rules, check-out time, key handover and similar matters.
3. Damage and Liability
The guest is responsible for damage caused by their own fault. Intentional damage, illegal activity or a neighbour complaint may result in booking cancellation + account closure.
4. Safety and Emergencies
In an emergency (fire, gas, safety), the guest must first call competent authorities such as 112/110/155. EstateB2B may intervene as support.
4) PAYMENT, COMMISSION AND REFUND TERMS
1. Payment Flow
Payments are received through EstateB2B’ payment infrastructure. The payout rule to the property owner is, for example, 24 hours after check-in. EstateB2B may hold payment/payout in a suspicious transaction.
2. Commission and Service Fee
EstateB2B may charge the guest a “service fee” and the property owner a “commission”. Rates are displayed on the listing/booking screen.
3. Refund Process
Refunds are made according to the cancellation policy applicable to the listing and the payment provider’s processes. EstateB2B is not responsible for delays caused by the bank/payment provider.
4. Fraud and Chargeback
In the event of a chargeback (reversal), EstateB2B may restrict the relevant account, request evidence and suspend the booking.
5) CANCELLATION POLICIES
The property owner selects one of the following packages in the listing:
A) Flexible: full refund up to 48 hours before check-in; at 48 hours, refund excluding the first night + service fee (example).
B) Moderate: full refund up to 7 days before; at 7 days, 50% refund (example).
C) Strict: 50% refund up to 14 days before; at 14 days, no refund (example).
Note: the “min_days / max_days / gap_days” rule for daily apartments affects booking availability, not cancellation.
Force Majeure
In situations such as an official prohibition, natural disaster, war or serious public-security risk, EstateB2B reserves the right to regulate cancellation/refund of the booking.
6) REVIEW AND RATING RULES
1. Genuine Experience Requirement
Only a party that made a genuine booking may leave a review.
2. Prohibited Reviews
Insults, threats, hate speech; advertising, links or sharing personal data (phone, address); false/organised reviews. EstateB2B may delete these reviews and impose sanctions.
7) PRIVACY POLICY
1. Data Collected
Identity/contact: full name, email, phone; account data: login records, IP, device information; booking data: dates, number of persons, messages; payment data: transaction information via the payment provider (card information may not be retained on the Platform).
2. Purpose
To provide the service and conduct the booking; prevent fraud; provide customer support and resolve disputes; fulfil legal obligations.
3. Disclosures
To payment providers; to public authorities where legally required; to technical infrastructure providers.
4. Retention Period
Data are retained for the period required by legal obligations and service necessity.
5. User Rights
For access/correction/deletion requests under KVKK: info@reztowns.com.
8) DISPUTE AND SUPPORT PROCESS
1. Complaint Period
If there is a problem, the guest must report it within 24 hours of check-in. Refund rights may be limited in case of late notice.
2. Evidence
Photos/videos, message records and check-in/check-out evidence may be requested.
3. EstateB2B Decision
Based on the evidence, EstateB2B may decide on a partial refund, booking cancellation or a warning to a party.
9) SECURITY: OFF-PLATFORM PAYMENT PROHIBITION
If a property owner or guest requests off-platform payment/deposit/IBAN: booking protection ceases; the account may be suspended; and the fraud risk is deemed accepted.
